Subscription & Refund Policy

This TinySnap Subscription and refund policy sets out the rules applied to the use of Services and System as indicated in the Terms of service agreement.

1. General provisions and definitions

1.1

This Subscription Policy shall be applicable and interpreted in line with Agreement. The definitions set out in the Agreement shall be applicable to this Subscription Policy.

1.2

The Company shall have the right to unilaterally modify and / or update the Subscription Policy at any time without notice. The continuous use of the Services / System by the Client shall be deemed as acceptance of Subscription Policy in the last and most updated version. Any Client shall periodically check and assess the Subscription Policy.

1.3

The latest version of the Subscription Policy shall be the latest uploaded to the Company's Website.

1.4

By agreeing to the Agreement as per the rules set forth in the Agreement, You are automatically agreeing to the Subscription Policy.

1.5

If You disagree to be bound by the Subscription Policy in any scope or way, You must not use or must immediately cease Your use of the Services, System or any part of it, as well as its features and functionalities.

2. Subscription term and pricing

2.1 Subscription model

Most of our Services are offered through subscription model. Upon ordering and purchasing a Service, You will have the option to select a specific subscription plan from the available options.

  • 2.1.1 Subscription plan options may include different pricing / term variations, and You shall choose one option.
  • 2.1.2 Subscription plan options may include various discounts and limited-time offers, as well as upgrade options, for example – reduced price for a fixed period of time, with regular price applicable for the remaining subscription period. You shall always analyze the provided options and make sure You are aware of applicable prices, discount / offer conditions and terms, and understand Your obligations in full before making the order.
  • 2.1.3 By selecting a subscription plan You agree to be bound by its terms and pricing.
  • 2.1.4 The chosen plan will be clearly identified in Your purchase confirmation (such as the invoice, email confirmation You will receive upon subscribing to our Services) and will be seen on the System.

2.2 Subscription periods

Subscription plans may have the following periods:

  • 2.2.1 Subscription plans typically include an initial period at a reduced price. Such a period with reduced (discounted) price is referred to as the "Initial Phase" in this Subscription Policy. The price of subscription plan usually is linked to the Initial Phase and longer Initial Phase results in lower subscription plan price or other benefits for the Client.
  • 2.2.2 After the Initial Phase, the regular (full) price of the subscription plan will be applied. The period when the regular (full, without reduction / discount) price is applied is referred to as the "Regular Phase" in this Subscription Policy.
  • 2.2.3 In case no Initial Phase is applied, such period of the Service provision is considered to be a Regular Phase.
  • 2.2.4 For the avoidance of doubt, the Company provides the following example: if You choose subscription plan with 2 months Initial Phase with reduced price, You will initially be charged at the rate of reduced price for the service provision period of first 2 months, and later You will be charged regular price for every following service provision period of the same length until You cancel Your subscription as per the rules set in this Subscription policy.

2.3 Auto-renewal

Following the conclusion of Your initial subscription plan, Your access to the Services will be auto-renewed for an additional period for the pricing of the Regular Phase. The subscription will automatically renew at the end of each period, and the corresponding price will be charged to the Client.

  • 2.3.1 The applicable Service will be automatically renewed for a renewal period (with the exception of 1-week renewal, which will be automatically renewed to 1 month period renewal), equal to the most recent service period of your order, at the then-current subscription rate (which is usually lower at the Initial Phase, and non-promotional (regular) during the Regular Phase), with payment taken from the payment method chosen by the Client when making the initial order.
  • 2.3.2 The number of renewals is unlimited and the renewal procedure shall be continued until canceled by the Client.

2.4 Renewal periods

The renewal of Services will be for the same duration as the single separate period the Service shall be paid for. For example, if You choose a 2 months Initial Phase with a discounted price, renewals will occur every 2 months (2 months at the reduced price, later – every 2 months at the regular price). The Company can provide You with subscription plans (weekly, monthly, or multi-month options - primarily 2 or 3-month), which may vary from time to time.

2.5 Billing procedure

You will be billed and charged for the next period after the initial period has passed, unless You cancel beforehand. For example, if You choose a subscription plan with 2 months Initial Phase and make the initial payment on 5th of July, the second payment for the following 2 months service provision period will be charged after the chosen Initial Phase period. The exact calendar day may change in the event of a payment failure or if the scheduled payment day is a non-working day in Lithuania. In the event of a payment failure due to reasons on the Client's side (such as an expired credit card or insufficient balance), the Company may attempt to automatically reprocess the payment (but not more than 6 times in a 2-month period).

  • 2.5.1 The charge will be made using Your selected payment method. To avoid auto-renewal charges, You have the right to terminate Your subscription before the scheduled charge date as per the rules indicated in this Subscription Policy.

2.6 Subscription plan details

Subscription periods are generally 1 week, 1 month, 2 months, but can vary. Clients must read the subscription description that appears upon selecting a plan to understand the specific terms and conditions. By subscribing You are getting the Snap Credits which number depend on the chosen subscription plan. Snap Credits allocated under each subscription plan are valid only for the duration of the selected subscription period and will expire at the end of that period. For example, if You choose a 2-month subscription, any unused Snap Credits will expire at the end of the two months and will not carry over to any subsequent auto-renewed period.

2.7 Subscription plan modification

The Company may offer You to upgrade Your subscription or purchase additional services via a one-time payment. These offers are provided at the Company's sole discretion and are governed strictly by the specific terms and conditions outlined in the relevant promotional materials.

3. Subscription plan cancellation

3.1 Initial Phase cancellation

If You choose to cancel during this period, You shall be aware that no refunds will be issued for the paid period.

3.2 Cancellation notice

To cancel Your subscription, You must provide notice at least 48 hours before the start of the next service period. If cancellation is not made within this timeframe, You will be charged for the following period, and the subscription will be canceled effective the period after the paid period.

4. Refund policy

4.1 No refunds

No refunds will be issued for any paid subscription periods, except under the following conditions:

  • 4.1.1 14-day policy: Clients may be eligible for a refund if they contact the Company within fourteen (14) days of subscribing and have not used any Snap Credits from the subscription. The initial Snap Credit provided and used during the sign-up process does not count as usage under this Subscription policy and does not disqualify You from a possibility to get the refund (or part of it) under this Clause.
  • 4.1.2 Company's fault: Clients may be eligible for a refund (in full or partial) if the Services were not provided due to the Company's fault.
  • 4.1.3 Promotional campaigns: If a refund option was offered as part of any promotional campaign by the Company, Client may be eligible for a refund (in full or partial) as specified in the promotion.
  • 4.1.4 Exceptional refunds: In exclusive instances, the Company may decide to refund the Client if the request is motivated, and circumstances show that a refund is reasonable, fair, and necessary. The Company has full discretion to make a decision on whether to issue a refund. Clients who believe they are eligible for this exception should contact the Company via the Contact Form in the "Contact" section.
  • 4.1.5 Refunds are not guaranteed and will be assessed on a case-by-case basis.

5. Miscellaneous

5.1

The English language version of this Subscription Policy is the prevailing version to any other possible version.

5.2

Any update of this Subscription Policy comes in force at the moment it is published at the System as indicated in the Clause 1 of the Agreement. By using the Services, You agree to be bound by any updated version of the Subscription Policy.

5.3

You are encouraged to contact us by the means indicated in the Agreement in case You have any question regarding this Subscription Policy. Contacting us via the Contact Form in the "Contact" section shall be considered to be the primary means of communication.

5.4

The Company shall reply to Your inquiries within 30 days (with the possibility of two 30-day extensions).
